Inform DMCA Copyright Infringement Notification and Counter-Notification Procedure

INFORM respects the intellectual property rights of others. However, INFORM does not independently confirm that all content made available through the INFORM Sites or Services is provided by a valid rights holder. INFORM will promptly remove materials from the INFORM Sites or Services in accordance with the Digital Millennium Copyright Act ("DMCA") if properly notified that the materials infringe a third party’s copyright. In the event that INFORM becomes aware that a person who is not a valid rights holder has provided content published on or through an INFORM Site or through a Service, INFORM may, in appropriate circumstances, disable and/or terminate the publication of such content. In addition, INFORM may terminate the accounts of repeat copyright infringers.
1. Filing a DMCA Takedown Notice to Remove Copyrighted Content
If you believe that your work has been copied or published in a way that constitutes copyright infringement by any content posted on any Inform Site or available through a Service, please provide us with a written notice containing the following information:
- Your name, address, telephone number and email address;
- A description of the work you claim has been infringed;
- A description of where the work you claim to be infringing may be found, sufficient to permit us to locate the material (e.g., the URL);
- A statement of your good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf; and
- Your physical or electronic signature.

2. Filing a DMCA Counter-Notification to Restore Removed Content
If your video is removed due to a takedown notice, you may ask the person who requested removal of your video to retract their claim. If you believe that your material has been removed by mistake or misidentification, please provide INFORM with a written counter-notification containing the following information:
- Your name, address, telephone number and email address;
- A description of the material that was removed and the location on the INFORM Site where it previously appeared (e.g., the URL);
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, any judicial district in which INFORM may be found, and that you will accept service of process from the person who filed the original DMCA notice or an agent of that person; and
- Your electronic or physical signature.

3. Repeat Infringer Policy
INFORM will terminate accounts that have been the subject of three (3) separate DMCA takedown notices. In the event your Content is removed due to a DMCA notice and is then subsequently restored due to the filing of a DMCA counter-notification, INFORM will treat the underlying DMCA notice as withdrawn. INFORM reserves the right to terminate accounts that are the subject of fewer than three (3) DMCA notices in appropriate circumstances, such as where there is a history of violating or willfully disregarding INFORM’s Terms of Service.
